The seller and owner of the Online Store is Sailovnia Sp. z o.o. with headquarters in Gdynia 81-571 at ul. Chwaszczyńska 131b, NIP: 586-23-20-395 REGON: 367779980 KRS: 0000686842 (KRS position in the register of entrepreneurs), registration authority: District Court Gdańsk-Północ in Gdańsk, VIII Commercial Division of the National Court Register Share capital: PLN 5,000.

§ 1. DEFINITIONS

Store - website belonging to the seller, available at www.sailovnia.pl.
Client - an adult natural person or a company placing an order in the store.
Regulations - these regulations.
Goods - a movable item, available for sale in a store.
Registration - a one-time activity consisting in setting up an account by the Customer, made using the administration panel provided by the Seller on the Store's website.
Order - Customer's declaration of intent aimed at concluding a contract for the sale of Goods at a distance via the Store, specifying at least the type and number of Goods.
Order Processing Time - the time during which the Order is completed by the Seller and then issued to the carrier; The Order Processing Time does not include the delivery time (the time between the delivery of the Order to the carrier and its release to the Customer);

§ 2. GENERAL RULES

The Regulations define the rules for the conclusion and performance of the contract for the sale of Goods in the Store and the rules for using the Store.
The Customer may contact the Store by e-mail: hello@sailovnia.pl, the contact form on the Store's website and by mail.
In order to use the Online Store on the Customer's side, the following minimum technical requirements must be met: a device with Internet access, an installed and updated version of the Internet Explorer, Chrome, FireFox, Opera, Safari with JavaScript and Cookies support enabled, an active e-mail account electronic (e-mail).
All Goods available in the store are new, have no defects and have been legally placed on the Polish market.
The condition to start using the Store is to read the Regulations and its full acceptance.

§ 3. SUBMISSION AND FULFILLMENT OF ORDERS

The customer can purchase the goods included in the assortment of the Online Store by placing an order. Orders can be placed 24 hours a day, seven days a week via the website of the sailovnia.pl online store
Orders placed on non-working days will be processed on the first working day following the day on which the order was placed.
The condition for placing an order is to fill in all the required data needed for shipping in the form, i.e. name, surname, delivery address, e-mail address, contact telephone number. Incorrect completion of the form or providing incorrect data may result in the withdrawal of the Online Store from the execution of the Order.
Until the selection of the Goods is confirmed with the "Buy and pay" button, the Customer has the option of making changes and modifications to the Goods and shipping data. Confirming the order via the "Buy and pay" button is tantamount to the obligation to pay the price of the Goods and shipping costs, about which the Customer is informed before the order is approved.
The acceptance of the Order for execution is each time confirmed by the Store by a return e-mail sent to the e-mail address indicated by the Customer in the Registration Form and is tantamount to concluding a Sales Agreement.

§ 4. PRICES AND PAYMENTS

The prices of products in the Store are given in Polish zlotys and are gross prices. The prices do not include the costs of delivering the product to the customer, which are given separately.
In the event of a change in the prices of the Goods, the Order will be processed at the price applicable at the time of placing the Order.
The Seller reserves the right to change the prices of goods on offer, introduce new Goods to the Online Store's offer, remove existing goods from the Store, carry out and cancel promotional campaigns on the Store's websites or make changes to them, in accordance with the standards of the Civil Code and others and laws such changes do not infringe the rights of persons who concluded contracts for the sale of goods offered by the Store, prior to the introduction of the above-mentioned changes or rights of persons entitled to use a given promotion, in accordance with its rules and during its duration.

Settlement of transactions by credit card and e-transfer is carried out via Sky-Pay.
If the Customer chooses the payment method in the form of a prepayment, failure to receive the payment within 3 days of placing the order will result in the cancellation of the order.
Consolidation, security and disclosure of essential provisions of contracts concluded by means of distance communication takes place by providing the customer with a proof of purchase. The proof of purchase may be sent in electronic form or together with the order.

§ 5. SHIPMENT OF GOODS

The goods are shipped within the territory of the Republic of Poland and the EU to the address provided by the Customer in the order.
The execution of the Order begins from the moment the amount of the sale price (and possible shipping costs) is credited to the Store's bank account if the Customer selects the payment method as online prepayment. In the case of cash on delivery, the execution of the order begins with the conclusion of the sales contract specified in accordance with § 3 para. 5
Orders are processed on working days. Orders placed on Saturdays, Sundays and public holidays are processed on the next business day. The maximum execution time is 14 business days from the moment the amount due is credited to the Seller's bank account or the sales contract is concluded.
The date of receipt of the shipment consists of the time of order fulfillment, including the time when the funds are credited to the Seller's bank account (usually up to 2 business days) and the expected delivery time.
The goods are delivered to the address indicated in the territory of the Republic of Poland and the European Union by a courier company, and using the "Paczkomaty InPost" service, depending on the option selected by the customer. There is also an option to pick up the goods free of charge from the warehouse located at Chwaszczyńska 151 E Street by prior arrangement with the Store's staff.
Shipping costs within the territory of the Republic of Poland, regardless of the chosen form of delivery, are borne by the Seller.
Estimated delivery time is:
1- 2 working days when choosing a courier parcel
2-3 business days when choosing a shipment via "Paczkomaty InPost"
2-6 business days when choosing a EU shipment via DHL/DPD/UPS

§ 6. RETURN OF GOODS - WITHDRAWAL FROM THE CONTRACT

The customer has the right to withdraw from the contract of sale of the shipped goods without giving any reason within 14 days from the date on which the customer came into possession of the goods or on which a third party other than the carrier and indicated by the customer came into possession of the goods.
To exercise the right to withdraw from the contract, the Customer must inform the Store about his decision to withdraw from the contract by means of a statement (download the statement of withdrawal from the contract) sent to the address of Sailovnia Sp. z o.o 81-571 Gdynia, Chwaszczyńska 131b.

With the note "RETURN", no later than 14 days from the date on which he informed the Store about the withdrawal from this contract.

The customer bears the direct costs of returning the purchased Goods
In the event of withdrawal from the contract, the Store returns to the Customer all payments received by him, including the costs of delivering the Goods, no later than 14 days from the date on which the Customer informed the Store about the decision to exercise the right to withdraw from the contract.
The reimbursement of the Customer's payment will be made using the same payment methods that were used by the Customer in the original transaction, unless the Customer expressly agrees to a different solution.
The Store may withhold the reimbursement of payments received from the consumer until the Goods are returned or proof of their return is provided.
The Customer is responsible for reducing the value of the returned Goods, resulting from using them in a different way than was necessary to establish the nature, characteristics and functioning of the goods.

§ 7. COMPLAINTS

If the products have defects that are non-compliant with the contract, the customer may file a complaint.
Complaints should be submitted by e-mail to the address hello@sailovnia.pl. After receiving the confirmation of receipt of the notification, the customer should return the advertised goods to the following address: Sailovnia Sp. z o.o. 81-571 Gdynia, ul. Chwaszczynska 131b with the annotation "COMPLAINT".
The customer will receive information on the method of considering the complaint within 14 days from the date of receipt by the Store of the parcel containing the goods complained about.
If the goods have defects, the Customer is entitled to the following claims (Article 556 and Article 561 of the Civil Code): a) submitting a declaration of withdrawal from the contract or reduction of the price of the Product, or, b) request to replace the Product with a non-defective one or remove the defect.
If the complaint is not accepted, the goods will be sent back to the customer together with the refusal of the complaint and its justification.
§ 8. PRIVACY POLICY AND PERSONAL DATA PROTECTION

§ 9. INFORMATION ON SERVICES PROVIDED ELECTRONICALLY

The Store provides the following services to customers by electronic means a) Enabling on-line conclusion of contracts for the sale of goods in the Store in accordance with these Regulations, b) Enabling the creation of Customer accounts in the Store, c) Sending the ordered commercial information regarding the goods.
The customer is entitled to withdraw from contracts for the sale of goods in accordance with the relevant legal provisions and on the terms set out in these Regulations. In addition, the Customer is entitled at any time to demand that the Store ceases to provide the services indicated in point 1 b) and c) above.
The technical conditions for the provision of electronic services by the Store are as follows: a) Access to the Internet, b) Using a web browser that allows editing hypertext documents (such as Internet Explorer, Opera, FireFox or similar), c) Having an e-mail account.
Complaints regarding the services provided by the Store by electronic means may be submitted by sending a complaint to the e-mail address conact@sailovnia.pl. The customer's complaint should include the customer's designation and a short description of the complaint. The Store will make every effort to ensure that the reported complaints are considered as soon as possible, but not later than 14 days from the date of receipt of the complaint by the Store. The Customer will be informed about the method of considering the complaint via a message sent to the e-mail address provided by the Customer.
The Seller informs that, depending on the settings of the Customer's web browser, he may enter into the ICT system used by the Customer, cookies that are not a component of the content of the services provided by the Store, and that enable the subsequent identification of the Customer entering the Store's pages and are used by the Store. in order to facilitate the use of the Store by the Customer, as well as to monitor Customer traffic on the Store's websites. The customer may at any time disable the use of cookies by the Store through appropriate settings in his web browser.

§ 10. FINAL PROVISIONS

Polish law applies to the contract for the sale of products in the Store. The contract is concluded in Polish.
In matters not covered by these regulations, the provisions of the Civil Code or provisions of other legal acts applicable to the operation and functioning of the store shall apply accordingly.
The competent court for resolving disputes is the local court with jurisdiction according to applicable regulations.
The customer may use extrajudicial means of dealing with complaints and redress. In order to take advantage of the possibility of amicable settlement of disputes regarding online purchases, the Customer may submit his complaint, e.g. via the EU ODR internet platform, available at: http://ec.europa.eu/consumers/odr/
Dealer. reserves the right to amend the Regulations at any time. Amendments to the Regulations apply to orders placed after a given amendment to these Regulations, subject to the provisions of paragraph 2 above.
All copyrights to trade names, logos and brands used on the website www.sailovnia.pl belong to their owners. Using them on the store's website is only for the purpose of better, more precise labeling of products.
